97th DA seeks AG opinion on Sunset funds

District Attorney Paige Williams is seeking assistance from the Texas Attorney General to resolve what she calls a “Catch 22,” in the now dissolved City of Sunset.
How does a city that no longer exists dispose of its remaining tax funds and pending restitution from an embezzlement case?
Williams prepared a request for opinion posing that question to Ken Paxton, Texas Attorney General, which was received by the opinions committee on March 10. It is noted as RQ-0015-KP.
The request seeks an opinion on whether the City of Sunset “may pay its remaining assets and assign its interest in the court judgements to the local not-for-profit corporations, which directly benefit its citizens. And if not, then to whom must it pay its remaining assets and assign its interest in the described judgements.”
