Misdemeanor case against former police chief dismissed

The 2014 abuse of official capacity $20 to $500 case against former Bowie Police Chief David Scruggs was dismissed in 97th District Court this week.
District Judge Jack McGaughey signed the motion to dismiss on March 21 and it was filed with the district clerk.
The motion to dismiss the Class B Misdemeanor was filed by Dustin E. Nimz, a Wichita Falls attorney who was named to serve as special prosecutor in January.
District Attorney Casey Polhemus said she wrote a letter to the judge letting him know why she could not serve as the prosecutor. The judge in turn selects an attorney to serve from a prepared list.
The original indictment in the case came in October 2014 nine months after he was terminated as police chief, a job he had since December 1995.
