STATE: Paxton asks for lawsuit to be dismissed

Published

Texas Attorney General Ken Paxton on Monday filed a response to DraftKings’ lawsuit seeking to test the legality of paid daily fantasy sites, and their operation in Texas.
Paxton filed the motion in Dallas County Civil Court, requesting the court either dismiss or move a lawsuit concerning the attorney general’s legal opinion.
For months, Paxton has argued daily fantasy sports sites are illegal, and he has questioned the premised of online gaming.
DraftKings sued Paxton, saying many customers (especially in the Dallas-Fort Worth area) cancelled their accounts after the attorney general issued his legal counsel.
In January, Paxton said, “odds are favorable a court would conclude that participation in paid daily fantasy sports leagues constitutes illegal gambling, but that participation in traditional fantasy sports leagues where the house does not take a cut is not illegal gambling.”
Texas is unique in that state law only requires “partial chance” for something to be considered gambling – and that does include raffles, but not drawings. Read more in the May 7 Bowie News.
